Terms of Use
Effective Date: July 01, 2026
Welcome to the American Whiskey Scholar educational platform. The following Terms of Use ("Terms," "Agreement") govern your access to and use of the American Whiskey Scholar online curriculum, student dashboard, and certification testing infrastructure hosted via Thinkific (collectively, the "Platform").
Please read these Terms carefully before purchasing a course or creating an account. By purchasing enrollment, establishing a student profile, or interacting with the Platform, you agree to be bound legally by these Terms. If you do not agree to these Terms, you may not access or use the platform.
1. Eligibility and Age Requirements
The American Whiskey Scholar curriculum involves the study, appreciation, and history of distilled spirits.
- By creating an account, you represent and warrant that you are of legal drinking age in your country, state, or geographic jurisdiction of residence (e.g., 21 years of age or older in the United States).
- If you are purchasing this course on behalf of an employee or a corporate team, you represent that you have the authority to bind that entity to these Terms.
2. Account Creation and Security
To access the single, compiled master class, you must register for a student account directly through our Thinkific portal.
- Accuracy: You agree to provide accurate, current, and complete information during the registration and checkout process.
- Credentials: You are solely responsible for safeguarding your Thinkific login credentials and password. You agree not to share your account access link or credentials with any third party.
- Accountability: Any activity occurring under your account is your sole responsibility. If you suspect unauthorized use of your student profile, you must notify us immediately.
3. Intellectual Property Rights
All materials hosted on the Platform, including but not limited to video lectures, text lessons, downloadable guides, tasting protocol templates, the American Whiskey flavor wheel graphics, quiz questions, and examination formats, are the exclusive intellectual property of American Whiskey Scholar and its curriculum experts.
- Limited License: Upon purchase, you are granted a limited, personal, non-exclusive, non-transferable, and revocable license to view and interact with the content for your personal, non-commercial educational use.
- Prohibited Actions: You may not copy, reproduce, screen-record, redistribute, sell, broadcast, modify, or create derivative works of any curriculum materials without express written consent from American Whiskey Scholar. Violation of this clause will result in immediate termination of account access without a refund and may subject you to legal liability.
4. Course Progression and Certification Rules
To maintain the prestige and integrity of the American Whiskey Scholar Level 1 Certification, the following educational boundaries are strictly enforced:
- Sequential Progression: The curriculum is organized chronologically as a compiled master class containing 10 individual learning modules. The Platform enforces sequential navigation. You are physically blocked from jumping ahead, skipping content, or unlocking the Final Exam course until you have successfully completed the content in each preceding module.
- The Final Examination: To secure your official Level 1 Certification, you must successfully complete the separate comprehensive final exam course with a passing score of 80% or higher.
- Integrity: You agree to complete all quizzes and exams entirely on your own, without the assistance of external generative AI tools, unauthorized materials, or third parties.
5. Fulfillment of Physical Rewards
Upon achieving a passing score on the final examination, American Whiskey Scholar will issue a digital credential and coordinate the delivery of physical milestone achievements (such as your official lapel pin).
- Shipping Address: You are responsible for ensuring that the shipping address provided in your student profile is accurate. We are not responsible for delivery failures resulting from incorrect address inputs.
- Fulfillment Timeline: Physical items are dispatched through third-party logistics and fulfillment partners. While we strive to ship rewards promptly following certification validation, shipping timelines may vary based on geographic location. If in the continental US you should receive your certification lapel pins within 14 business days after successfully passing the test.
6. Payments, Refunds, and Cancellations
All e-commerce transactions, payment processing (via integrated secure payment gateways), and order generation occur natively within the Thinkific ecosystem.
- Pricing: The price for the Level 1 Certification single master class is $450 USD. Prices are subject to change, but changes will not retroactively affect already purchased enrollments.
- Refund Policy: Due to the instant electronic delivery method of our educational platform, all sales are final. Once an account is provisioned or access to the master class is granted, no refunds or credits will be issued under any circumstances.
7. Account Termination and Deletion
- By Us: We reserve the right to suspend or terminate your access to the platform at any time, without notice, if we believe you have breached these Terms, engaged in academic dishonesty, or infringed upon our intellectual property.
- By You: You may request the deletion of your account at any time. Please note that permanently deleting your student profile will completely wipe your academic transcripts, verified testing scores, and digital certificate history from the system.
8. Limitation of Liability and Disclaimers
- Educational Purpose: The Platform is intended solely for educational and informational purposes. American Whiskey Scholar does not promote the excessive or illegal consumption of alcohol. Please taste and study responsibly.
- "As-Is" Service: The platform is provided on an "as-is" and "as-available" basis. While we rely on Thinkific’s industry-standard technical safeguards, we do not guarantee that the platform will be 100% uninterrupted, completely secure, or entirely error-free.
- Liability Cap: To the maximum extent permitted by applicable law, American Whiskey Scholar shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use or inability to use the platform.
9. Changes to the Terms of Use
We reserve the right to modify or replace these Terms at any time to reflect operational modifications, platform updates, or regulatory shifts. Any revisions will be published directly to this page with an updated "Effective Date".
